Terms of Service

Acceptance of Terms

By accessing or using the Servinix platform and services, you agree to be bound by these Terms of Service. If you do not agree, do not use the services.

Description of Services

Servinix provides a cloud-based software platform for field service businesses, including fleet GPS tracking, field service management, customer communication tools, AI voice automation, and related software features.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Acceptable Use

You agree not to:

  • Use the services for unlawful purposes
  • Attempt unauthorized access
  • Interfere with or disrupt the services
  • Transmit malware, spam, or harmful content
  • Reverse engineer the platform except as permitted by law
  • Harass, abuse, or impersonate others

Payments and Billing

Paid features require a valid payment method. Fees are billed as described in the applicable order form or subscription terms. Except as required by law, fees are non-refundable. We may update pricing with advance notice.

Subscriptions to Servinix renew automatically each billing period (monthly unless otherwise specified) at the then-current rate, charged to your payment method on file. You can cancel at any time from the Servinix dashboard or by emailing legal@servinix.com. Cancellation takes effect at the end of the current billing period. We do not pro-rate refunds for partial periods, except as required by law.

If we change pricing, we will provide at least thirty (30) days advance notice by email or in-app. The new pricing applies on your next renewal after the notice period.

Founding-Customer Pricing

Servinix is in pre-launch through July 31, 2026. Customers who reserve a spot via the founding-customer form during this period lock in 60% off their current software invoice — 50% standard plus a 10% founding-customer bonus on top. Locked pricing applies on day one of the platform going live. No credit card is required to reserve a founding-customer spot. Servinix may close founding-customer enrollment at any time. If the launch date moves, locked pricing applies on the revised launch date.

Intellectual Property

Servinix and its licensors own the platform, software, content, branding, and related intellectual property. Subject to these Terms, you receive a limited, non-exclusive, non-transferable right to use the services for your internal business purposes.

Your Data

You own your customer data, your business data, your call recordings, and your fleet telematics data (collectively, “Customer Data”). Servinix processes Customer Data on your behalf to operate the platform.

For thirty (30) days after your subscription ends, you can export your Customer Data through the Servinix dashboard or API. After that 30-day window, Servinix may delete your Customer Data. If you need a longer window, email legal@servinix.com before your account closes and we will work something out in good faith.

Servinix does not sell Customer Data, and Servinix does not use Customer Data to train third-party public AI models. Servinix may use de-identified or aggregated data derived from Customer Data to operate, improve, and benchmark the service.

If you bring a phone number to Servinix or acquire one through the platform, you may port that number to another provider on cancellation. Servinix will cooperate with reasonable porting requests.

Service Availability

We strive to provide reliable service, but the platform may be unavailable from time to time due to maintenance, outages, or events beyond our control.

SMS Messaging Terms

By providing your mobile phone number and opting in, you agree to receive SMS messages from Servinix related to demos, scheduling, account notifications, service updates, support communications, and product-related operational messages.

  • You may opt out at any time by replying STOP to any message.

Consent to receive SMS messages is not a condition of purchasing any goods or services.

Mobile carriers are not responsible for delayed or undelivered messages.

Voice and Recording Compliance

If you use Servinix's AI Service Assistant or any feature that records, places, or participates in voice calls on your behalf, you agree that:

  • You are the party legally responsible for obtaining any consent required to record calls in the jurisdictions where you and the other party to the call are located.
  • You will keep Servinix's default recording-disclosure announcement enabled on inbound calls, or replace it only with an equivalent notice that satisfies applicable law.
  • You will not use the AI Service Assistant to place outbound calls in violation of the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state mini-TCPA laws, or applicable Do-Not-Call registries.
  • You will indemnify Servinix against claims brought by your end-customers alleging that calls handled on your behalf were recorded, transcribed, or placed without lawful consent, except to the extent caused by Servinix's failure to follow your documented instructions.

Data Processing Addendum

Customers that require a written Data Processing Addendum (DPA), Business Associate Agreement (BAA), or other data-protection contract may request one by emailing legal@servinix.com. Servinix will provide its current standard DPA on request and will negotiate reasonable customer-specific terms in good faith.

Disclaimer of Warranties

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Servinix shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity. Servinix's total liability for any claim arising out of or relating to the services shall not exceed the amounts paid by you to Servinix in the twelve (12) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Servinix from claims, damages, liabilities, and expenses arising out of your misuse of the services or violation of these Terms.

Termination

We may suspend or terminate access to the services if you violate these Terms. You may stop using the services at any time.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

General Provisions

Force Majeure. Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, pandemics, wars, terrorism, civil unrest, government actions, labor disruptions, internet or utility outages, or third-party service failures.

Assignment.You may not assign these Terms without Servinix's prior written consent. Servinix may assign these Terms in connection with a merger, acquisition, financing, or sale of substantially all of its assets.

Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement. These Terms, together with any order form, the Privacy Policy, and any DPA executed between you and Servinix, constitute the entire agreement between the parties regarding the services.

Notices. Servinix may send you notices by email, through the Servinix dashboard, or by posting on this page. You may send notices to Servinix at legal@servinix.com.

Changes to Terms

We may update these Terms from time to time. Updated versions will be posted with a revised effective date. Continued use of the services after changes become effective constitutes acceptance of the revised Terms.
